DARBY URGES LEGISLATURE TO REPEAL ALL EXISTING HATE CRIMES
Montgomery attorney Larry Darby opposes renewed calls for legislation that would
establish more hate crimes in the state of Alabama. Further, Darby urges the
Legislature to begin the process necessary to repeal all existing hate crimes.
Calls for special rights for homosexuals who are beaten up after allegedly
initiating unwanted homosexual advances on others are based on emotion, not
sound reasoning that comes from thoughtful consideration of the issues at hand.
Crimes of violence are deplorable but existing laws adequately punish those
persons convicted of wrongdoing. Laws against crimes of violence, such as
assault or battery, already contain the element of "intent" (to commit the
crime). That is to say, the state of mind (mens rea) of the perpetrator is
already considered by existing law. Therefore, at best and if the motivation
behind calls for more hate legislation is innocent, then such legislation would
be redundant.
If the legislation is designed to be an enhancement or to affect sentencing,
then the Legislature needs to back away entirely. Aggravating or mitigating
circumstances to be considered at sentencing is best left to the trial judge.
When the Legislature attempts to micromanage the criminal justice system the
constitutional doctrine of Separation of Powers must be considered.
Whether the motivation for hate crimes is innocent or sinister, adding another
layer to the mental element can only lead to bad things, perhaps best described
as an Orwellian Ministry of Truth, where Free Speech is effectively throttled.
To understand this one must consider that Free Speech consists not only of Free
Expression, but Free Thought and Free Inquiry as well. To see the danger of
establishing hate crimes one only need look to jurisdictions that have well
established hate crimes.
Hate crimes lead to political prisoners.
The U.S. has deported scientist Germar Rudolf based on hate crime laws in
Germany. Other such political prisoners, based on the genuine victims engaging
in Free Expression, include Robert Faurisson, Roger Garaudy, and Dieudonne
M'Bala M'Bala in France; Siegfried Verbeke in Belgium; Juergen Graf and
Gaston-Armand Amaudruz in Switzerland; Guenter Deckert, Hans Schmidt and
Fredrick Toben in Germany. And former Tennessee resident Ernst Zundel was picked
up at his home, whisked to Canada where he stayed two years without being
charged before being sent to Germany where he is to be prosecuted for speech on
a US-based web site that can be read by citizens of Germany. British historian
David Irving sits in an Austrian jail cell today because of words he spoke in
1989 that have been deemed thought crimes. Again, hate crime laws are perhaps
best described as establishing an Orwellian Ministry of Truth. You are free to
say whatever you want to say so long as your speech or thoughts conform to
government dictates. Another way of viewing hate crimes is that such laws are
nothing short of a revival of blasphemy laws, where you can be imprisoned or
punished for your opinions.
As attorney general, Larry Darby will examine statutes and proposed legislation
for clarity and constitutional validity, and with a view that the sole object
and only legitimate end of a representative government is to protect its
citizens in their enjoyment of life, liberty and property.
